Legal Question in Employment Law in Utah

Expulsion from Teaching Program--Weber State University

I was removed from the teaching program at WSU without any warnings given. They gave grades and referrals as the reasons. Their policies said if grades ever were below 3.0, they were to mail a dept letter and have me meet with my Secondary Advisor. They never did. They also had 4 negative referrals written that lead to the expulsion. Their policy said that they had to tell me after one and counsel with my advisor about how to resolve the issue. They never did. Finally, they refused to recognize the cause of a lot of the problem--bipolar disorder. I lost 2 years of salary and spent $25,000 more on 2 more years of school, fighting it. What are my chances in winning reimbursement for this travesty?

You may be able to win readmission, but it is not likely that you will win reimbursement UNLESS you can show that WSU knew or should have known of your bi-polar disability and made accomodations for you under the ADA. Were you employed by WSU during this period? On what did you spend the $25k?

Have you pursued any appeals or administrative remedies?
