Legal Question in Employment Law in Utah

My husband is a salaried employee. Occasionally he works less than 40 hours in a week and his company docks his pay, conversely on weeks he works over 40 hours he is not compensated. Is this legal? Specifically withholding pay for less than 40 hours worked as a salaried employee

A salaried employee is paid - generally monthly - for performing certain tasks. If his salary is $3000 per month, he gets $3000 regardless of the time it takes to do the work. It sounds like his boss is cheating him - unless there is some sort of agreement.
