Legal Question in Employment Law in Utah
my huspand (james) was fired about a month ago we are still fighting to get unemployment. the manager claimed he had been told to improve (when the week before he had been fired the boss took him out to lunch and told him he was doing a good job.) also claimed that he had a no call no show which is also not true we carpool to work being we worked at the same place and there is another witness to this as well. now his claim to unemployment changed and is saying james quit. we cant pay for rent or much of anything else because he cant find work and we arent getting any unemployment. james has a specific guy he is supposed to be talking to on this matter, but everytime james talks to him he says he will call back and never does or he doesnt answer at all. How can we get this unemployment and get money for the time lost? it doesnt seem right he can change his claim and unemployment continue to believe him. He is lying to the government, everyone who works here can vouch that the manager indeed did fire James.

If he's made an application for unemployment and it has been denied, he can appeal the denial and they will convene a hearing before a hearing officer at the Dept. of Workforce Services to hear your husband's side of what happened as well as any testimony or statement from any third parties. Generally, they will grant the application.
