Mechanics Lien
My son works for a solid surface countertop fabricator in Salt Lake City. His boss has not been to work for 2 months now, and very little before that. My son and his co-workers have not been paid for several weeks. I was wondering if they could file a mechanics lien, or something similar on the equipment that thier boss has, to be able to get some sort of payment for thier work. They know that their boss owes alot of people, because they are calling the company trying to get paid also. He might owe something on the equipment. I am wondering how they might go about getting paid, as their boss doesn't care about them or much else.

The employees should contact the Utah Department of Employment Security and file a complaint. Employees wages get priority over some creditor claims. They should consider getting a new job, or even as a group attempting to purchase the company. Based on what you explained, the company will probably wind up in bankruptcy. However, sometimes the employees are able to purchase the company out of bankruptcy and then run it themselves.
