Legal Question in Employment Law in Utah
personal slander and unfair treatment
I was recently denied a tenure teaching position by my building administrator who I believe is not actually qualified to determine whether or not my performance the last 3 years was sufficient or proves me competent. She gave me no prior notice/warning or opportunity to improve she just informed me of her decision at the end of the school year. Her actions are completely unwarranted and unsubstantiated. Furthermore, her actions are personal slander towards me that will forever affect my career. Every time I apply for another teaching position in another school district, I have to answer yes to the question ''have you ever been denied tenure?''. The director of services in my field (special education)for the school district gave me a score of 100% on my latest evaluation and said my performance is outstanding! I know as the building administrator, my principal determines who does and does not receive tenure positions, however in this case, because as she herself has said several times, she does not know anything about special education and what my job entails. Two questions for you...can she do this and what can I do about it? What does the law say?

Re: personal slander and unfair treatment
There should be a grievance or appeals procedure in the district - or some higher officer to whom you can appeal. If all appeals are exhausted, you will have to file suit. Look at the tenure requirements to see if the school violated their policy.
