unpaid commision by employer for goods sold

For the past year I have received a commision of 1.5% on all sales above $50,000. Today I was informed that I will not be paid for $200,000 worth of sales for the month of April 2003 because the profit margin was not high enough on the job. This error was due to wrong information in the estimating paramaters of our bid software.(overhead #'s material costs, etc.) So the bid was low due to no fault of my own. Can they legally not compensate me to the agreed amount

You are entitled to your usual and customary commission, particularly if the fault was not your own. Check to see if your employer has any kind of salesman agreement, company employee policy, or other document which establishes a company policy regarding commissions. If not, you are entitled to your commission.
