Legal Question in Employment Law in Utah
I work for an Animal Control Agency. We are closed weekends and nights and only respond to emergencies. Each employee is required to be on call during the night one night a week. And for an entire weekend usually once a month. During that on call time, we have to call back every person who calls emergency dispatch to determine if they have true animal emergencies or not. We dont get paid for all of the phone calls we make. We only get paid if we end up responding to a call. Sometimes you spend hours on the phone at night or over the weekend and you may not get paid any overtime just because you physically did not have to respond to any calls. Can the city do that?

You should be entitled to comp time or pay for the time on the phone.
