Legal Question in Employment Law in Utah
I work as a food server and have been with company for 4 yrs. 2 yrs at last location, working 6 days a week the past year. I had a disagreement on the floor with the new G.M. last Sunday. After our conversation, I went to my table where they had hears our whole conversation and were bothered by it. I apoligized and asked if I could do anything to make things better? They stated it was fine. After they left,I went to another manager on duty where I explained what happened, he informed me they had said something to him as well. That was it,or so I thought? Keeping in mind, on my behalf, I have NEVER had a customer complaint in the 4 yrs working there. I have worked with at least 3-6 managers which can verify this is true. The next day was my day off but another employee texed me and asked,"what happened?" I wasnt sure what she was talking about, but she informed me my name was scratched off the schedule. At that time,I called the restuarant asking to speak to the G.M. I was told she was busy, call back. I left messages but she never returned my calls. Later that evening I finally spoke to another manager,asking her what was going on? She stated she wasnt sure but was told to tell me I needed to be there at 3 and on time for my scheduled shift. I showed up at 2:25 where I was met by another manager and taken to the office. They told me I was being suspended for the customer complaint and also being a "table hog" I continued trying to reach the G.M. the rest of the week, where finally on Friday afternoon spoke to her. The outcome was, she fired me over the phone for the reasons above. Is this legal? Also, how can I be the only one at fault in this situation when she, the general manager was the one having the arguement with me on the main dining room floor? Please help

You can be fired for any reason, with or without cause. Your remedy is to apply for unemployment. Your manager may object, then you will need to make sure the Div of Labor hears your story.
