Do I have to work overtime?

Is it legal for an employer to require its employees to work overtime (more than 40 hours)?

The Fair Labor Standards Act, a federal law, regulates some, but not all, businesses. Generally, companies can demand overtime but must pay time and a half - even to salaried employees.

If you are severely burdened by overtime one option is to terminate your employment and seek unemployment compensation until you can get another job. Your employer may object and appeal, and at the hearing you must argue that the overtime was so severe that it created an unfair and intolerable work environment.

Another choice is to organize a union, or get as many other employees to join with you in a protest.

Your final choice is to sue.
