Legal Question in Employment Law in Utah
I work for a Travel Agency and contract with another company in New York for groups I sent there. Once the group finishes traveling this company sends me a commission check. I had a group in November where a Mother and two sons pulled out of the trip because the teacher had roomed an adult male in with her two sons and another boy. They were not paid in full. Because of this the company in New York is not sending me any of the commission, saying they will not pay until the Mother pays for tickets and tours purchased. Is this legal for the company to withhold my commission? I sent all monies back for the other 21 participants? I would appreciate knowing if a company can do this.
1 Answer from Attorneys
It depends on the terms of the agreement with the agency
