Legal Question in Landlord & Tenant Law in Utah
We rented a home in Mountain Green for 9 months, (from the same landlady for 2 years prior in Kaysville). The original lease term was 12 months, however the landlady chose to let us out of our lease when we asked. We knew she was in short sale and concerned about the home being foreclosed on with us still occupying the home. We gave more than 30 days notice and upon the orignial 30 days, we have not received our deposit back. The home was cleaned and in good condition, there are no reasons for us not to receive our deposit back. I texted, emailed, and spoke to her on the phone and she said the place was in good condition; but that we would have to deal with her husband (who is frequently out of town and an alcoholic). My husband has emailed them again today 6/15/10; 46 days later, and still no deposit or any explanation. Besides ourselves we had a cleaning lady and mutual friends inspect the property before our final departure. What can we do?
Thanks, this situation is extremely stressful; especially since we moved to this home strictly because she asked us to stating she couldn't make her payment. We thought we were helping her out, and instead all our help (at this and her two other homes) is thankless.

You will have to sue them for your deposit. You can sue in small claims court.
