Brain Injury at Birth
Does the statue of limitations (4 yrs) apply when a child most likely suffered the brain injury at birth, but the diagnosis was not made until he was almost 4?

The statute of limitations begins to run when one learns of the injury or reasonably should have learned of the injury. In your case the statute probably has not run. However, you should not wait any longer before you take action, since there will be legal arguments of when you reasonably could have learned of the injury.
