Legal Question in Medical Malpractice in Utah
Hospital gave our daughter hepatitis b.
Our daughter was born in 1988. She was born with Turner's Syndrome, which came with other problems ie poly-cystic kidneys, liver disease. She has had more than twenty procedures at the same facility with numerous blood transfusions. When she was 4 yrs old, they told us she had contracted Hepatitis B. They say they looked back at the blood she was given and all tested negative. Then they shut the door. We feel that was not the only opportunity for her to get Hep B from the facility with her numerous procedures. We have declared bankruptcy due to medical bills and we feel that it should not be all our burden.

It is my understanding that Hep-B can only be transmitted through direct contact. Because of the age of your daughter one would assume that it was transferred from one of her medical care providers. Even though blood was tested, there is no guarantee that an infected needle may have been used. Your recourse is to sue all of the medical care providers for the cost of the Heb-B care in the past and future; for the costs of complications arising from Hep-B on her other illnesses; and for her lost income from the disease. You may also recover on your daughter's behalf some damages for pain and suffering.
