Legal Question in Personal Injury in Utah
Hello,
The area that I live in has a water canal in the bak of our house, the canal is posted private, the other day someone was racing down the canal road at full speed on an ATV, I yelled out to him to slow down there are kids playing 20 ft away, he did not slow down at all, he then turned around and came back full speed once again, at that time I threw an object up in the air approx 100-150 ft away from him to get his attention to slow down, he then got very angry and slowed down then jumped off his ATV and came back to me with threats, at the time when he was yelling at me, his ATV was still rolling and ended up falling into the canal, the police came and talked with the driver, he said that I threw the object at him which caused him to drive his ATV into the canal, the police are now saying that I can be charged with a class B assault and could be moved to a class A offense, is there anything I can do to not be charged with this?
Thank you for your help.

The prosecuting attorney will review the facts given to them by the police and determine whether or not to file charges. If charges are filed, you will have to appear in court to defend yourself.
I have handled many criminal matters and would be happy to discuss the case with you for no charge. Please call IF and after charges are filed.
