Legal Question in Personal Injury in Utah
Out of State Auto Accident
We were in an MVA in Utah on our way to Spokane, WA to see my mother's grave. The other driver was cited, and he is from Missouri. We are from Arizona. His insurance company does not want to pay for our children's medical as each child (3 of them) all have medical bills less than $3000 each. My 7 year old daughter was bruised to the point of her eye being closed for a week. My wife and I have bills in excess of $5000 and $8000 respectively with mine growing.
I do not have PIP in Arizona, and my health insurance does not want to pay since the injuries are from an auto accident.
How should I approach this?

There are many possibilities. Depending on the injuries, you may be able to sue here in AZ. Possibly in Utah. I settled a big case in Idaho two years ago. Can help more with more information.

You can use an attorney here but realize that ultimately Utah would be the site if a lawsuit is filed. Therefore, the insurance laws of Missouri do not apply.
We do not have PIP in Arizona, but we do have Medical Pay, which is similar.
See an attorney. You need professional help on this one. We offer free, no obligation consultations at 480.835.1500 and have handled more than one thousand of these cases. We also have experience in conservatorships for minors when there is a settlement. Do not delay in speaking with an attorney, in that your ongoing decisions will affect the case. Do not have further discussions with the insurance adjusters until you get legal advice. Also, I am wondering what happened with the payment for your automobile. Also, your health insurance can be forced to pay, but you will need an attorney to help.

You are going to have to sue the other driver. You can sue in Utah or where the other driver lives.
