Fashion labels, like other product marks, are protected in the United States by state and federal trademark and unfair competition law. Marketing a product with a brand's mark that is not made or licensed by the owner of the brand is a violation of the law, and will make the seller liable for monetary damages, and subject to entry of an injunction. There are a number of theories under which a brand owner might recover, and the damages can be significant.
