Legal Question in Real Estate Law in Utah

Could Adverse Possession Apply?

About 8 years ago, I moved into my grandmother's house due to the fact that she was going into the nursing home. Since she was on Medicade, only a member of the family could reside in the home. I had to maintain the premises and pay taxes and utilities on the home. 7 years ago she passed away. Immediately the State requested us to contact them or they would put a lein on the home. We did so and the State said they would get back with us when they figured out if they were going to put a lein on/take the house. They said they wanted us to remain in the home and still maintain it. We would also have first option to buy, since we were living in the home. Well, the State never put a lien on the home. Would we be able to use adverse possession if we have paid the taxes for the past 7+ years? The home was suppose to go to the State, but they never decided to take it.

Re: Could Adverse Possession Apply?

You can file a quiet title action to get the title to the house in your name. You have been more than patient. The 7 years should satisfy the adverse possession claim requirements.
