Legal Question in Real Estate Law in Utah
How do I get out of my apartment lease?
I am a tenant, and I have about 4 more months left on my lease. I have an opportunity to move to a better place. I have given my notice to the apartment, but they want me to move out, and continue to pay rent until the apartment is leased, is this legal?

Re: How do I get out of my apartment lease?
The language of the lease determines whether or not you can leave early. If there is no early termination clause, you will be obligated for the lease through the end (4 months?). The landlord has a "duty to mitigate" which means if you leave he must take reasonable steps to rent the apartment. If he rents it then you would only have to pay for the vacant unpaid period, plus the landlord's costs to get it rented.
