Legal Question in Real Estate Law in Utah

Deed In Lieu

We are in the process of foreclosure on our home. The sale is emminent in a few weeks. A friend mentioned to me the possibility of doing a Deed in Lieu as an alternative to the foreclosure. Is it too late in the process to consider this option?

Thanks

Re: Deed In Lieu

You can offer a deed in lieu of foreclosure, but it is up to the mortgage holder to accept or decline it. Most likely if the sale date is near they will elect to foreclose, since foreclosure cleans up the title at the same time. You may want to consider some other options, such as Ch 13 bankruptcy. Ch 13 allows you to stop foreclosures, create a plan to pay some funds to all of your creditors, and if you are upside down on your house (and other pledged assets such as cars) have the principle amount reduced and interest altered to be in line with current market rates. If you are interested, I also may have access to private parties would may purchase your home. Call if you have questions.
