What steps need to be taken to get ernst money from a buyer that sounldn't get his loan.

Most earnest money agreements for the purchase of property are subject to the buyer getting a loan. If the loan is not obtained, the buyer cannot be compelled to perform. Read the earnest money agreement carefully, it sets forth the rights of buyer and seller.
