Legal Question in Real Estate Law in Utah

Eviction after foreclosure on our home

We filed bankrupsy before the date of our foreclosure but the attorney did not get it filed in the court in time so the sale of the property took place. Last night we saw a lady tape a paper to our front door and it said we have three days to vacate. we have three children, one who is on SSI, and only one income barely making minimum wages. how do we get more time before having to move and was the notice we received proper. we have never had any communication with anyone since the sale of our property and have no idea who purchased it. this happened on a friday and we havw no place to go. what can we do?

Re: Eviction after foreclosure on our home

You must immediately contact your attorney and have him attempt to get the sale set aside.

If you stay past the three days, the new owners can file a court action to have you evicted. You may want to have your attorney contact the new owners for you.

If he knew of the impending foreclosure and failed to file timely, he may be liable for malpractice.
