Legal Question in Real Estate Law in Utah

two forclosers at once

We are all ready in forcloser with our 1st mortgage can we go into forcloser with our second? We sold our house for enough to pay off both loans and to pay the legal fees for the 1st. We are scheduled to close two days after the 2nd mortage is supposed to go to forcloser. Is there any thing we can do so as not to get any new legal fees from the 2nd mortage?

Contact the party doing the foreclosure and ask them to take whatever money you can pay them at your closing on the second. Generally a second mortgage will work with you.
