Legal Question in Real Estate Law in Utah
Irrigation water flooding basement
My home borders a corn/hay farm. When the farmer irrigates his fields, the water level raises and floods my basement. I have paid a plumber to install a sump pump ($500) and have installed 3 new pumps in the past 5 years ($350, each). What can I do? Does this famer have to keep his water on his property? What steps can I take - any advice would help.
Thanks You!

Re: Irrigation water flooding basement
If the water table raises when the farmer irrigates his property, you can only install equipment to keep the water out of your home. If the surface water escapes the farmer's fields and encroaches onto your property, you can require the farmer to contain the water.
