Legal Question in Real Estate Law in Utah

I am a landlord. The Tenant and I have an "unsigned" Lease Agreement that we have treated as signed. She has paid the rent late every month and has added in the late fees as stipulated in the Lease. She paid me June's rent on the 12th and I deposited it on the 12th. I was informed today that she put a stop payment on the check.

I am going to start eviction process but don't know whether I treat this as a month-to month OR a non-payment of rent on a lease agreement. Help?

Month to month unless there is a written lease agreement.
