Legal Question in Real Estate Law in Utah
Listing accused murderer's property
I have an ex-co worker from years back, this co-worker shoots and kill his wife. He is now in prison awaiting trial.
His brother who has the power of attorney calls me up to list the co-workerss house which the accused and deceased wife held as joint tenants. Can I list the property?

The power of attorney must be valid and in writing and provide for the attorney-in-fact (the brother) to be able to deal with the real property. It would be best if the document specifically states that the brother has the power to sell the real property.
