Legal Question in Real Estate Law in Utah

How long do renters have to move out after they are notified they must leave?

Our landlord is building another house on the same plot of land that the house we are renting from him is sitting on. The county will not allow more than one house on a plot of land this big so they are going to force him to tear down the older one. My question is, how long after they say we must vacate do we have to vacate the house? I have been hearing 60 days but I don't know for sure. My Landlord says that it depends on what the county does, it could be three weeks or five months. It will depend on whether they will let us live there while they build or if the county will let us live there till they move in. Any advice would be appreciated.

Re: How long do renters have to move out after they are notified they must leave

If you are on a month to month rental agreement, you have 30 days from the date the landlord gives you written notice. If you stay longer, and if he has to evict you, then you could be liable for additional expenses.

If you are on a lease, you are entitled to remain in the house until the end of your term. If the county condemns the place or requires you to leave before the end of the lease, the landlord may owe you the difference between your current rent and the rent you are required to pay at a new location for the balance of your lease - and maybe also the costs of moving.

If you do not move when the county tells you to move, and if the landlord relies on the county to remove you, you may have several months depending on how aggressive the county is about removing you. Your risk is that if the county files a suit to have you removed you may have some extra costs and attorney fees to pay.

In short, you now know you will have to move eventually, it would be wisest to start looking now for a place to rent so you don't have a hassle, nor are in a hurry when you get your notice.
