Legal Question in Real Estate Law in Utah

misrepresantation of personal credit

I am currently making an effort to establish my personal credit by using letters of credit from landlord, utilities etc...and join a loan with my girlfriend for the purchase of our new home.

Well my current landlord filled the form out incorrectly ,therefore,it was resubmitted via fax .

when filled out the second time it read we are 30 days delinquent on 11 months of payments to our current landlord. which is not true and we can prove this fact with bank records. also is a comment which reads ''They usually pay''. we feel this matter is completely ''Unprofessional'' as well as insulting and a malicious act of ''Slander'' .

We certainly appreciate the service you provide and hope to hear whether or not we have been violated in the manner we explained above.

We have all copies of financial statements and a copy of the fax in which we were misrepresented.

Re: misrepresantation of personal credit

I assume that the report was submitted to a credit reporting agency. Discuss your concerns with the landlord. Then ask the landlord to resumbit a corrected copy. If the landlord does not cooperate pull a credit report to see if it was published. You have the right to contest incorrect information with the credit reporting agency. You can also submit a statement to credit reporting agency about your position on the landlord's report.

It is not slander.

I also counsel against purchasing a home with your girl friend. If you are committed enough to buy a house together, get married first. Purchase of a home is a 30 year obligation. If your relationship falls apart you cannot simply take a name off a mortgage loan. If the relationship doesn't work, and one person wants out it is more difficult to force a sale of the property. Marriage will also improve your chances for financing - it demonstrates to a lender a higher level of responsibility and commitment.
