Mortgage payments not applied timely

A private lender purchased my 2nd mortgage from Bank One. I mail my payments to him, yet he does not apply my payments for approximately seven days after he receives them, which has resulted in me being overcharged thousands of dollars in interest over the past two years. What can I do?

(1) Contact and see if you can get an adjustment; (2) Sue to see if the court will compel him to make an adjustment.
