Preconstruction deposit

Do I have any legal right to get a ''non refundable'' pre-construction deposit returned to me if

A: I can no longer qualify for the loan due unforeseen job change and reduction in pay and

B: the home-builder's financing dept recommended that I borrow money from family in order to qualify--even AFTER knowing my now-lower income didn't support the house payment and

--name removed-- the home builder was able to sell the home (approx 8 months later)?
