Haven't received copy of contract from builder

My wife and I entered a contract to buy a home that was about one-quarter completed. We paid a significant amount of earnest money and signed the contract. The individual who needed to sign for the builder was not available, so he was going to sign later and we were supposed to receive a copy the next day. It's been three months and at least three requests later and we still haven't received it. Could we cancel this contract if we wish?

If the seller has not delivered to you a signed copy of the contract, there is no binding contract. If you want your deposit back there is no good reason why it should not be returned.
