Legal Question in Real Estate Law in Utah

I rented out my home in Utah on Aug. 7th, 2009. On a recent visit to the home to do a repair, we found out that one of the tenants fathers is living in the basement without prior consent from us. The lease states that the preises shall be occupied by no more than the agreement at lease signing. Is this a lease violation, and if so, what are my rights and options as the owner/landlord?

If the tenants are not complying with the terms and conditions of the lease, then you can evict them. Usually the provisions about additional tenants at the property is so that adjustments in rent, utilities, parking, etc can be made. But, if it is not allowed in the lease and they have not done what is required to add a tenant, you can evict the tenant - all of them, not just the subtenant. That is why many leases provide that the property is leased to ___ adults and ___ kids.
