retaining wall

who's responsible for repairing a retaining wall?

Our backyard backs to property of an apartment complex. The owner says it's our responsibility because he was there first. The wall is retaining his property and we feel it's his responsibility.

There are not enough facts to answer your question. Generally the party who builds the wall is responsible for maintenance.
