Legal Question in Real Estate Law in Utah

security deposit

Our apartments were sold and we have a new owner. The old owner is refusing to transfer our deposits to the new one. He has returned half the deposit to us and we are waiting on the other half. Can the new landlord ask us for a deposit?

Re: security deposit

The new landlord can enforce the terms of the lease agreement you signed with the old landlord, if a deposit is required then you have to provide one. However, you gave the old landlord a deposit and that should have been transferred to the new landlord. Where the old landlord is not returning all of the deposits to you, I suggest that you give the new landlord what was returned to you and have him get the balance from the old landlord. You should not get caught inbetween the landlords, it is their problem to resolve. You do not have to pay double deposits. Read your lease so you know your obligations and rights.
