Legal Question in Real Estate Law in Utah

Selling property when not all owners of record agree

My brothers, sisters, and I own a piece of recreation property. There are 6 of us on the Deed as having equal share. If all but one of us want to sell the property, is there a way to sell the land if that one owner refuses to sign the property over?

Re: Selling property when not all owners of record agree

You have several options. The nonselling member can keep his interest, and the remaining 5/6 be sold to a buyer, if the buyer is willing. OR the nonwilling member can buy the other's interests. Or you can go to court to order the property partitioned, so that the 1/6 owner can keep part of the property with the remaining being sold. There may be other options.
