Shared Well Agreement

We have water rights approved by the state that come from a well located on our neighbors property. We are in the process of selling our property and the new owner's lender requires a shared well agreement. Can the neighbors refuse to let the new owners access the well for maintenance or can they refuse to let them have water from the well?

Probably not, you have likely acquired an easement which could be formalized in court if they refuse to cooperate.
