Legal Question in Real Estate Law in Utah

Tenants not paying

I had tenants that didn't pay rent so I evicted them. They responded to the courts that they didn't pay because I said I was going to lose the house to the bank because they didn't make the full mortgage payment. I told them I had worked out a deal with the bank that they would take partial payment and that they needed to pay rent. They still refused based on thinking they couldn't keep the home. I let them know that if they made up all the back payments plus the deposit the bank would not take the home. They still did not pay. I therefore filed papers to evict them. In the response to the court they stated they did not deny that they owed the rent. If they do not deny they owe me would I win in court a judgement for the back rent and if so could I garnish their business receipts since they own their own business?

Thanks,

Josh
