Legal Question in Sexual Harassment in Utah

Harassment vs Sexual Harassment?

My husband has worked for a company 5 yrs, great work history and ethics. The other day while walking down the hall, one of the woman co-workers stopped abruptly in front of him. He tapped her on the behind with the back of his hand as if to ''hurry up''. This was not the right way to go about it. It happened so fast he noted.

Another woman who saw it happen, reported it. Later that day, the boss retrieved him from the job-site, said there would be an investigation. Stated he would be put on unpaid leave until investigation finished. However, at another plant this happened to another employee and they terminated him; so with my husbands' good work record it would be better if he just quit. This is what he did. The next day his final check was prepared. Upon picking up; the woman the incident happened to informed him she had no problem with him and did not report this and told him who did. She was almost in tears and fearful of losing her job. Was this sexual harassment? Did things go too quickly- in terms of letting my husband go? Not even finishing out the day? The boss even told my husband if it were up to him, they would just say, ''Don't let it happen again.'' What do you think...justified?

Re: Harassment vs Sexual Harassment?

The touching you reported was not sexual harassment. Your husband probably reacted too hastily. I am not sure what you are asking about justified, since your husband quit, nothing else happened. Maybw he can get his job back.
