i am getting divorced and my husband has to give me half of the retirement funds. is there any way for me to access this money?

You first need an order from the divorce court segregating the retirement funds. Once the order is entered and the funds are segregated, you will have your new account, from which you can withdraw funds - but remember the withdrawal is accompanied by a stiff tax penalty.
