Legal Question in Tax Law in Utah

I am a member and officer of a square dance club located in Ogden, Utah. I have read articles in the paper recently regarding the IRS putting tax-exempt groups on notice about filing for tax exempt status.

My club knows nothing about the requirements for filing for tax-exemption.

Does a small square dance club have to file and can you quote where I can find information about this and/or the forms necessary to do so.

If your organization wants tax exempt status you need to file either Form 1023 (for the most common type of exempt organizations (501(c)(3)s) or Form 1024 for other types of exempt organizations.Without approval from IRS your organization is (should be) taxed as an unincorporated association. This means you are taxed like a C corporation and should file Form 1120 to report the transactions that took place in the organization. I would look at the IRS web site to start on their charities and nonprofits page. Here is the address. http://www.irs.gov/charities/index.html?navmenu=menu1 would be the place to start. Feel free to call me if you have questions.
