Legal Question in Wills and Trusts in Utah

change of trustee

My husband and I had our wills done a few years back and listed a trustee. We would like to change the trustee. Can we type a note stating the change and sign and date it and have it considered legal. The trustee was never given a copy of the will. We have the only copies, which are kept in a fire proof safe.

Re: change of trustee

You need a paper which specifically references the trust document and section naming the trustee, language which substitutes the new trustee. The document must be witnessed by 2 witnesses and a notary which witnesses all signatures. If not done exactly right, it is invalid. It would not be expensive for this lawyer to do it for you, and you would be assured of it being correctly done. If both of you die at the same time, can someone get into the safe?
