who can initiate probate and is it the law? My brother is the so called executor of my mother who live together in Las Vegas. My sister who had POA over her is now facing criminal financial theft of the elderly, my brother who is more of a rip off type person has convinced our mother to sell everything and more in with his girlfreind who has done time for financial fraud crimes. When she dies, I want to ensure that they are not lining their pockets and then saying to the rest of the family that there really wasn't anything there to share with anyone.

You should file a complaint with the police where your mother lives. It sounds like financial abuse of an elder person. You can petition at any time to be appointed her conservator, and that will give you power to determine what has happened to her assets.
