Legal Question in Wills and Trusts in Utah

Irrevocable or Revocable Trust?

I am getting married and would like to set up a trust to protect my money. An attorney suggested I set up an irrevocable trust. Does anyone know of any good attorneys in Utah who specialize in this sort of thing? I would like to find one who is also a CPA/Investment Broker specialist.

The attorney I consulted said she thinks such a trust would cost about $1,500 and would take about 2 weeks to set up. Does this sound reasonable to you?

Thanks in advance!

Re: Irrevocable or Revocable Trust?

Whether or not to use an irrevocable trust, a living trust, or some other mechanism is subject to the details of your individual case. Note: your money is not a marital asset, it is "premarital" and as long as you keep it separate from the marital funds, your new husband will not have a claim on it. However, estate planning is always a good idea and something which you should consider. The price quoted is not unreasonable for a simple estate plan, but make sure you are getting also a will, durable powers of attorney, living will, and all of the necessary information to fund and activate your new trust.

Re: Irrevocable or Revocable Trust?

I do a substantial amount of estate planning, involving both revocable and irrevocable trusts, as well as other strategies and vehicles. I would like to ask some questions about how you want to use your money to determine if an irrevocable trust is the most appropriate vehicle. It is one possibility, but, depending on your particular circumstances, may or may not be appropriate. Please call me and I will be happy to discuss the matter with you. I am going to be out of the office Monday afternoon through Wednesday--I am going to an estate planning seminar those days. My number is 801-235-9400.
