Legal form for Probate

My husband died in April, the house is in his name. I understand that I have to go thru Probate court to have the deed put into my name. What form(s) do I need to submit to the court, and what other documents do I need besides the copy of his death certificate and copy of his will.

You need to file a petition to open probate and to be appointed the personal representative, along with a the death certificate and will. I do not know whether there are any forms available to the public, you can check at the district court nearest your home. OR you are welcome to call for a free consultation.

These are not forms that you can usually fill out yourself. You will need to file an application for informal probate of will and informal appointment of personal representative, the original will, a statement of informal probate of will and informal appointment of personal representative, an acceptance of appointment signed by the person requesting the appointment, waivers of notice signed by each heir, a form called informal probate of will and appointment of personal representative, and letters of administration.

I really want to urge you to hire an attorney to do this. I have had clients who, even with forms in front of them, could not fill them out properly, and ultimately decided to retain an attorney.
