Legal Question in Wills and Trusts in Utah

Lost Will

My great aunt passed away 2 years ago. She had a will, but it mysteriously disappeared. The other side of the family is fighting over her belongings. She had written my mother a letter saying that ''if she doesn't change her will, --name removed-- will inherit her stocks in the phone company. We still have the letter, but I haven't done anything about it. Is there anything I can do, since the letter was written in her own hand several years before she passed on? Thank you I live in Alaska, she lived in Utah.

Re: Lost Will

Probate should be opened for your aunt. Any interested person can open probate and seek to be named the personal representative - whc then assembles all of the assets and bills, then applied to the court for permission to pay the debts and distribute the remaining assets to the heirs. Probate is usually in the place where the person dies. If probate is already open, you can petition to have the letter admitted as a holographic will.
