Legal Question in Wills and Trusts in Utah
My mother (who died 11 yrs ago) left a "life estate" to her husband of 6 years here in the state of Utah. He ran the house into the ground, became an alcoholic & moved out March 2010. The house is listed in the "personal residents trust" & deeded in my brothers name with me as the beneficiary. (we are 50/50 interest in the home) this guy moved out after embezzling all of the trust money. Said "he couldn't afford to live there anymore, he got an apartment. Is he still responsible for taxes & insurance on the home until the trust has been dissolved & does he have the right to move back in if he wishes?

If he embezzled funds you can sue him, or file criminal charges. You can also sue for breach and waste of the trust - and terminate his interest. However, until there is an order changing the trust there is little you can do.
