Legal Question in Wills and Trusts in Utah
Mus a Utah intervivos trust be attested to be a notary to be valid? What if the drafting attorney put in a notarial attestation in the document?
thanks.

Like any contract, there is no requirement that a trust be notarized. Although it would be best practice to have it notarized if the attorney included a notarial attestation, it does not have to be. The fact that it is not could lead to an argument that the testator decided not to complete the trust, though. Call me if you have any further questions.
