Obtaining a copy of a will

My father recently passed away. He had a substantial sum of money in cash and land. Originally us kids had heard that he included us in his will along with his current wife. I have never seen a copy of the will. It has been several months since he passed away, and us kids have not seen or heard anything. Can we request a copy of the will, and if so how do we go about getting a copy?

If his wife will not give you a copy of the will, you might try going to the District Court courthouse in the county where he died and check to see if probate proceedings have begun. If they have, there will be a copy of the Will on file with the court.

You can open probate. That is a procedure to determine who the heir is to a deceased person's estate. One of you can volunteer to be the personal representative, who is responsible for assembling all of the assets of your father and identifying the will. You should first request to see the will from the wife. If she does not produce it, you should then open probate.
