Legal Question in Wills and Trusts in Utah

Both of my parents are deceased. They left a will stating how the estate should be divided between 6 siblings and their spouses. One sibling died before my parents. Is the spouse of this child entitled to part of the estate?

It depends on what the will says. Most of the time, property is left to a person,, peer stirpes. This means that if that person predeceases the parent, the property goes to the children, not the spouse. However, sometimes the person writing the will wants a different result, and the nattorney will draft the will accordingly. Call me if you have further questions.
