No Personal Respresentative 4 years since death of miner

Our daughter 18 years old was a passenger in our vehicle driven by her boyfriend 17 years old who died from injuries as a result of the accident. We were told by the auto insurance that we have to sue the estate of boyfriend to help pay for medical expenses that our daughter has incurred. The boyfriend died intestate and nothing has been filed with the probate court. The accident was 4 years ago. is it to late for probate? if not what needs to take place?

You will need to sue the estate of the deceased boy, and make sure you name his auto insurance company, which is responisble for your daughter's medical bills. If he was not insured, and has no other assets, you will not recover anything from him. Investigate her auto insurance in force at the time to see if she had uninsured motorists coverage.
