Legal Question in Wills and Trusts in Utah

separate wills for married couples

Can i prepare a will without my husbands consent? We both want different people to be the guardian of our children if we should die while the children are young. My husband won't have a will prepared. So, can i have a will prepared on my own without his consent or knowledge?

Re: separate wills for married couples

You can have your own will prepared, which will reflect your wishes regarding your children and your property - however it is not binding on your husband's property.
